Polanski's attorney is to ask a Superior Court judge to rule that the director fulfilled his time behind bars in 1977 when the case to light.

Polanski's attorney, Harland Braun, argued that a December 2016 decision by the Polish Supreme Court not to extradite him should spur USA authorities to bring the case to a close.

Los Angeles prosecutors, however, said Polanski was asking for special treatment and there should be no discussion on what sentence he would get until he returns to the United States.

Extradition efforts in Switzerland and Poland have failed, but Polanski did serve almost a year in Swiss prison in the late aughts before authorities there made a decision to reject the United States' request and release him.

The almost 40-year-old court case centers on six felony counts from 1977 counts for the drugging and rape of a 13-year-old girl. He was accused of plying a 13-year-old girl with champagne and part of a sedative pill, then raping her at actor Jack Nicholson's house.

But LA prosecutors say that's their call, not Polanski's, Poland's, Switzerland's or, yes, even Meryl Streep's.

The lawyer told the court the victim in the case said she wants "this thing over with".

Braun wrote that Polanski is asking the court to "keep its promise of 90 days or less" and accept the district attorney's representation to a Swiss court that Polanski has credit for 335 days already served, or to sentence him in absentia - without Polanski appearing in court - to the 335 days he has already served. Judge Dariusz Mazur wrote a 200-page opinion detailing the failures of the American justice system in the case and calling efforts to extradite Polanski for a full trial "obviously unlawful". It's not unreasonable, Braun said, for his client to ask the judge what sentence he'd give the octogenarian director.

Hanisee refused, and Gordon did not indicate how he would respond.

Another straw in the wind was Braun's courtroom explanation of his request that the district attorney agree to at least a temporary suspension of an outstanding warrant for Polanski's arrest, so that he might fly in from France without fear of apprehension, and a court appearance in the blue jump suit and handcuffs that graced other defendants in Judge Gordon's courtroom on Monday.

Braun planned to attempt to release secret testimony by the prosecutor in the case upon his return to court Monday.

His attorney has said that Polanski wants to travel freely, without risk of extradition, and to return to the United States to visit the grave of his wife. "The people misunderstood" the request, said Braun; he assured that it was only meant to allow for Polanski's return.

Hanisee blamed Polanski for its odd procedural history.

His lawyers say that Polanski should get credit for the 40 years he's spent in exile from what he considers his "home" country, and say that both Poland and Switzerland, which have declined to extradite him back to the US, believed LA County was being unreasonable in continuing to pursue his case.

After hearing about 45 minutes of argument, Gordon said he would consider the matter and issue a written ruling.

"Mr. Polanski is 83 and just wants to settle this case, wants it over with".
