Two ex-officials set to testify against ex-Penn State leader
Former Penn State President Graham Spanier is getting ready for trial in Harrisburg.
The proceedings will begin this morning with jury selection.
Graham Spanier is facing felony charges of child endangerment and conspiracy stemming from the 2011 Jerry Sandusky child sex abuse scandal.
Recently, former University Vice President Gary Schultz and Athletic Director Tim Curley pleaded guilty to child endangerment charges. The newspaper reported Penn State Trustee Al Lord saying Spanier told him he would "rather go to jail for telling the truth than admit to a lie and say I did something I didn't do".
Spanier was forced out shortly after longtime assistant football coach Jerry Sandusky was charged with child molestation in 2011. Paterno died of lung cancer in 2012.
Prosecutors say Spanier and two of his former top lieutenants dealt with complaints about Sandusky more than 15 years ago.
During Spanier's trial, prosecutors are expected to bring up emails from 2001 that show the administrators considered going to police to report what former assistant football coach Mike McQueary saw. He had been the first school official to hear McQueary's account of the shower incident.
"The only downside for us is if the message isn't "heard" and acted upon, and we then become vulnerable for not having reported it", Spanier replied.
Originally listed as co-conspirators with Spanier, Curley and Schultz are now expected to testify against their former colleague, according to a witness list announced during the jury selection process. He called the plan "humane and a reasonable way to proceed". It's not known how long that will take or whether the trial itself will get underway today.
As a result, a Pennsylvania appeals court threw out numerous more serious charges against the three a year ago, and more recently the trial judge pared the case back even more.
It's not clear whether they will testify this week, as prosecutors and Spanier's lawyers have declined to comment, citing an order from the judge.
