Flynn won't honour subpoena - senate

Michael Flynn then – President-elect Donald Trump’s nominee for National Security Adviser arrives at Trump Tower in New York

The Senate Intelligence Committee is still negotiating with former national security adviser Michael Flynn to obtain documents for its counterterrorism investigation into Russian Federation and the USA presidential election, congressional aides said on Thursday.

The Trump administration has repeatedly denied collusion with Russian Federation.

"General Flynn's lawyers have said he will NOT honor the subpoena".

The Senate Intelligence Committee's counterterrorism probe took on added significance after President Donald Trump dismissed FBI Director James Comey last week amid allegations of Russian meddling in the 2016 USA presidential election. In 2008, the House voted to hold White House Chief of Staff Josh Bolten and former White House counsel Harriet Miers in contempt over their refusal to cooperate with an investigation into the mass firings of US attorneys by the administration of George W. Bush. Flynn, who had worked as Trump's national security adviser during the campaign and served in the White House for less than a month, has been at the center of the controversy.

"This was a problem because not only did we believe that the Russians knew this, but that they likely had proof of this information", Yates stated during testimony before the Senate Judiciary Committee on May 8.

Finally, the New York Times reported that Trump's administration was aware that Flynn was under investigation for working for Turkey's government, which he did not disclose at the time, and hired him as a national security adviser anyway.

Flynn Intel was paid only $530,000 for the work, which ended in November after Trump's election victory. Flynn had declined to cooperate with the committee's request in April.

On Thursday he called it "the single greatest witch hunt" in USA history.

On March 30, Flynn offered to testify before both the House and Senate Intelligence Communities in exchange for immunity.

Ousted Trump National Security Adviser Michael Flynn will not honor a subpoena issued by a Senate committee looking into Russia's meddling in the 2016 presidential election. "If they go the civil route, it takes just as long". Under 2 U.S.C. § 194, the committee and full chamber of Congress must certify the contempt referral, which is sent to a U.S. Attorney 'whose duty it shall be to bring the matter before the grand jury for its action.' Notably, a criminal contempt charge was certified against Attorney General Eric Holder, but the U.S. Attorney refused to bring it before the grand jury.
