ICJ stays Pak decision to execute Kulbhushan Jadhav

India on Thursday said the International Court of Justice's decision on Kulbhushan Jadhav is an "essential first step" in ensuring justice for him.

Meanwhile, Pakistan said the ICJ's decision has not changed the status of Jadhav's case in any manner.

He said the human rights situation in Indian-administered Kashmir is deteriorating.

The judges said India had a "plausible" argument that Pakistan violated worldwide law by refusing to grant consular access to Jadhav.

The spokesperson said that the International Court of Justice (ICJ) has given a revised declaration for Pakistan under the Article 36-2, which is stronger than the declaration of 1960.

India's external affairs minister, Sushma Swaraj, tweeted that the "ICJ order has come as a huge relief to the family of Kulbhushan Jadhav and people of India". "We are confident that India would not be able to hide the subversive activities it is trying to carry out through its agents like Commander Jadhav", stated an official statement by the Attorney General's office.

He added that ICJ was 'to determine jurisdiction prima facie which there was since 2008 agreement can t override Vienna Convention. He said Pakistan's reply to ICJ was in line with Article 36 (2) of the Vienna Convention that Pakistan does not recognise the jurisdiction of the ICJ in this case. In the same tweet, he drew parallel to Pakistan's unfulfilled World Cup dream of beating India with that of their craving for hanging Jadhav.

India counts the top United Nations court's ruling as a big win.

Mr Jadhav was "an innocent Indian national, who, incarcerated in Pakistan for more than a year on concocted charges has been held incommunicado... and faces imminent execution", India told the tribunal. "This order today highlights the importance of the fact that when a person is allegedly accused he has a right of effective defence", he said. While not commenting specifically on the order to halt the execution, the office said in a statement that Jadhav "still has ample time to petition for clemency".
