Pakistan Tehreek-e-Insaf blames Sharif for ICJ stay of Jadhav execution

The government should have sent the attorney-general to contest Pakistan's case in the International Court of Justice (ICJ), said opposition leader Khursheed Shah on Friday.

The International Court of Justice on Thursday blocked the execution of Jadhav, sentenced to death by a Pakistani military court on charges of spying and subversion.

The 15-member bench backed India's contention that there had been a violation of the Vienna Convention on Consular Relations as New Delhi's requests for consular access to its national had been denied 16 times.

"We are very happy to know that the International Court has given its verdict in favour of India. This was a game which started after Jindal's visit to Pakistan", she said. The relief sought by India from the ICJ includes suspension of the death sentence, declaring the trial by the military court as violative of global law, directing Pakistan to annul the trial, and if Pakistan is unable to annul the decision then the ICJ should declare the decision as illegal.

"Pakistan shall take all measures at its disposal to ensure that Mr Jadhav is not executed pending the final decision in these proceedings", said ICJ President Ronny Abraham. She suspected that the government wanted to hand over Jadhav to India and this was the outcome of Jindal's meeting with the PM. On May 9, the global court stayed the death sentence as a provisional measure.

Although Pakistani analysts were confident that the ICJ does not have jurisdiction to stay Jadhav's execution, the Dawn quoted unnamed observers as now saying that the jurisdiction argument was "weak" and "damaging".

If Pakistan does challenge ICJ's jurisdiction, said Kumar, the global court in the Hague will possibly consider the possibility of holding separate hearings for jurisdiction and India's petition.

Party leaders said that while the ICJ's decision had come as a big relief for the Modi government, they had consciously avoided any celebration because of the sudden death of minister Anil Madhav Dave. "Some activists had told me about this court where I could file a case against a nation. India did nominate one but Pakistan did not", Khokhar said, adding that Pakistan's counsel did not argue for the full allotted time either.

India has maintained that Jadhav was abducted from Iran, where he was pursuing his business, and passed off as a spy. The Hague-based ICJ heard the two sides on Monday where Pakistan had challenged the jurisdiction of the court but in its decision the court prime facie exercised the jurisdiction and accepted Indian pleas. The Vienna Convention has provisions for consular access to accused even in cases of terror and espionage, the court said. Therefore the court was "satisfied" of the "urgency" of the case.
