Ayodhya dispute: Apex court begins hearing pleas against HC verdict

The Uttar Pradesh government was asked to translate within 10 weeks the evidence recorded for adjudication of the title dispute in the Allahabad High Court into English.

With the SC to hear the dispute over Ram Janam Bhoomi-Babri Masjid on Friday, Shia Waqf Board pleaded to the court to decide its appeal along with other petitions.

A specially constituted bench, headed by Justice Dipak Misra, also directed contesting parties to translate their historical documents in English within 12 weeks since these were in eight different languages.

The bench made it clear that the parties would have to strictly adhere to the time frame fixed by it and no adjournment shall be given in any circumstances.

Earlier, the high court had ruled a three-way division of the disputed 2.77 acre area at Ayodhya among the parties - the Sunni Waqf Board, the Nirmohi Akhara and the Ram Lalla. The court says it will give him the opportunity after all parties are heard.

Senior advocate Shyam Divan, C S Vaidynathan and others, representing the other side including Ram Lalla, Nirmohi Akhara, submitted the court should not be wasting any more time and start considering the matter.

A three-judge Lucknow bench of the Allahabad High Court had on September 30, 2010 given a unanimous decision that Lord Ram was born under the central dome of the makeshift temple and Hindus have a right to worship there.

This is a major improvement when compared to the lawsuit as filed by the Sunni Central Waqf Board back in 1961 which stated that any idols near the mosque premises be removed and that the party would be in the ongoing litigations with respect to the Ayodhya-Babri Masjid title dispute.

Countering the prevalent perception that the mosque was built by Mughal emperor Babur, the board said it was actually constructed by his minister Abdul Mir Baqi, a Shia Muslim, out of his own funds.

During the 100-minute long hearing, the Muslim litigant argued against early hearing in the case holding the translation of documents from Persian and Urdu as important for the hearing to progress.

The mosque was demolished by Hindu Karsevaks on December 6, 1992 in Ayodhya. The Sunni Waqf Board tells Supreme Court that the translation of historic documents is not complete yet.

The Board also told the apex court in an affidavit that the Babri Masjid site was its property and only it was entitled to hold negotiations for an amicable settlement of the dispute.
