Benchmark sues former Uber CEO Travis Kalanick

Graves thanked staff and former Uber CEO Travis Kalanick. The complaint, which was filed in DE court, accuses Kalanick of "fraud, breach of contract and breach of fiduciary duty". The suit cited various media reports that said that Kalanick's continued participation oat the company has scared away candidates from the job, including current Hewlett Packard Enterprise CEO Meg Whitman.

The venture capital firm was one of the first investors in the ride-hailing service and was key in removing Kalanick from his post as CEO earlier this year.

According to the VC firm, this includes "pervasive gender discrimination and sexual harassment", as well as "allegedly harbored trade secrets stolen from a competitor".

Graves will continue to serve on Uber's board, it said. Kalanick is also accused of hiding a tool to deceive local authorities called Greyball from the board.

Uber and Benchmark Capital did not immediately respond to requests for comment.

Benchmark is seeking to make null and void the June 2016 shareholder vote and associated actions, which would eliminate the three board seats, including Kalanick's.

If successful, the Benchmark lawsuit could kick Kalanick off the board of directors, making his return impossible.

In his email to staff, Graves acknowledged that Uber itself was going through a bumpy transition, but he also framed the company's recent fall from grace as an opportunity to turn things around. Here's a copy of the complaint.
