ACLU sues Metro for rejecting controversial ads, saying its policy violates the First Amendment

Metro pulled down advertisements for Yiannopoulos's self-published book risky on July 7 after complaints from riders who objected to the former Breitbart writer's history of outlandish attacks of Islam, feminism, the Black Lives Matter movement, and individuals like the actress Leslie Jones. Just 10 days after the ads went up, WMATA directed its agents to take them all down and issue a refund - suddenly claiming that the ads violated the same policies it relied on to reject the ads from the ACLU, Carafem, and PETA. The ads themselves only displayed Yiannopoulos's face, the title of his book, and a blurb describing him as "the most risky man on the internet".

Among the ads the Washington Metropolitan Area Transit Authority refused to display was one from women's healthcare collective Carafem that features a picture of a white pill along with the text "10-Week-After Pill" and "For abortion up to 10 weeks".

Arthur Spitzer, the legal director for the A.C.L.U.'s District of Columbia chapter, said that the organization found the rejection of its own ad, which displayed the text of the First Amendment in three languages, particularly notable.

In an emailed statement, the Metro agency said on Wednesday that its board of directors "changed its advertising forum to a nonpublic forum and adopted commercial advertising guidelines that prohibit issue-oriented ads, including political, religious and advocacy ads", in 2015.

"Many viewers of the advertisement are aware that the play...contains many passages in which the Scalia character advocates his conservative judicial philosophy", the complaint reads.

"The ACLU will be representing me against the Washington DC Metro after the latter caved to pressure from progressive activists and tore down ads for my book, DANGEROUS", MILO said in a statement to Breitbart News.

For his part, Yiannopoulos appears to acknowledge the oddity of him standing on the same side as groups he's openly maligned in the past. "I'm joined in this lawsuit by fellow plaintiffs including pharmaceutical villains and vitamin-deficient vegans, but I'm no stranger to odd bedfellows".

"The First Amendment protects the speech of everyone from discriminatory government censorship, whether you agree with the message or not", he added. Strong opponents keep us honest.
