The named defendants in the lawsuit are Trump, Defense Secretary James Mattis, Chair of the Joint Chiefs of Staff Gen. Joseph Dunford, the secretaries for each of the military services and acting Secretary of Homeland Security Elaine Duke, who oversees the U.S. Coast Guard.

Several cities and police departments around the country have reached out to the trans community and shown their support with the message that their departments would welcome any trans military members who were kicked out due to the ban. "She fears that the President's directive banning transgender people from military service will result in her discharge from the military before she can reach this twenty-year benchmark, thus leading to a substantial decrease in her retirement payment", the lawsuit reads.

Lambda legal is one of the largest and oldest legal groups that advocate for LGBT+ rights in the USA and now the group is taking aim at the transphobic policy that was announced by Trump on Twitter last week.

But the suit filed Wednesday argues there is already a draft policy or de facto policy, stating, "Upon information and belief, the White House outlined a plan to end the active service of transgender servicemembers to be transmitted to the Department of Defense for implementation".

Their salvo comes even as it remains unclear if the Pentagon will take real action to ban trans people from military service.

"Last year, the Department of Defense announced that transgender people could serve openly", one anonymous plaintiff said in a statement. "This proposed ban, if implemented, would cause significant disruptions, deprive the military of mission-critical talent, and compromise the integrity of transgender troops who would be forced to live a lie, as well as non-transgender peers who would be forced to choose between reporting their comrades or disobeying policy", the retired officers said in a statement, The Hill reported.

LawNewz.com reached out to the White House for comment, but they have yet to respond. A source contended that the administration basically "wants to get rid of transgender service members as fast as they can".

"The categorical exclusion of transgender people from military service lacks a rational basis, is arbitrary, and can not be justified by sufficient federal interests", reads the complaint from the groups, on behalf of plaintiffs Jane Doe 1, 2, 3, 4, and 5. "And it did in fact go to great lengths to engage all branches of the military in reviewing and revising policy". The change hasn't been implemented.
